Lawyers for an Alabama football fan are getting more time to prepare for his trial on charges of poisoning the Toomer's Corner oak trees at Auburn University. A Lee County judge has granted a defense request to delay the trial of Harvey Updyke. The 63-year-old Updyke was set to go to trial early next month, but a hearing is now set for March 14 to discuss when the trial can be held. Defense lawyers won the delay by arguing they needed additional time to prepare expert witnesses, and prosecutors will also get more time to finish gathering evidence. Updyke has pleaded not guilty to charges of poisoning the Toomer's Corner oaks at the edge of the Auburn campus in 2010. It's still unclear whether the trees can be saved.
