The fate of a controversial clinic in Birmingham could be decided on Friday.
Judge Joseph Boohaker has decided that the state can move forward with its lawsuit to shut down the New Woman, All Woman Health clinic. He says once a protective order has been signed, the state can begin investigating.
The state is trying to shut down the clinic since 2012, saying it is an illegal abortion clinic. Two women were rushed from the clinic in ambulances and a subsequent investigation revealed the clinic was not in compliance for state rules. The state also believes the owner, Diane Derzis, is still performing them even though she surrendered her her license a year ago.
The state sued in March 2013, arguing the business is performing abortions illegally despite agreeing to shut down for a series of violations. The clinic denies the allegations.
Derzis' attorney withdrew a motion to dismiss the case, which means it could go to trial. Opponents are concerned that illegal abortions could continue at the center in the meantime.
