State Attorney General Luther Strange on Tuesday filed a lawsuit in Elmore County Circuit Court saying the Poarch Band of Creek Indians are operating, advancing, and profiting from unlawful gambling activity at casinos in Wetumpka, Atmore, and Montgomery. Although state police officers cannot enforce state law on Indian lands, the lawsuit contends that the Poarch Band still has an obligation to comply with state laws that prohibit slot-machine gambling.
Strange said in a release that he decided to file the lawsuit after his other efforts to stop gambling activities failed. His actions include two letters sent to the National Indian Gaming Commission requesting a top in gambling activities. Strange says he never received a response.
The lawsuit comes on the same day officials raided VictoryLand Casino in Shorter. The Montgomery Advertiser reports authorities seized several hundred machines and an undisclosed amount of cash. Agents with the attorney general’s office and the Department of Public Safety served a search warrant in response to illegal gambling operations.
In December, the Macon County Sheriff’s Office deemed gaming machines at VictoryLand to be legal bingo machines. Strange said the actions at VictoryLand were the culmination of an investigation that has lasted several months. Strange has been against gambling in the state since taking office in 2011, including a push for increased penalties for possession of the gaming devices.
Machines and money seized in the VictoryLand raid will be held in the Macon County Circuit Court as evidence until a foreclosure hearing can be held.
