A teacher accused of sodomy will be in court October 17 for his preliminary hearing.
Huntsville Police arrested Brett Naff on Monday. Naff is on leave from his job at The Country Day School in Huntsville.
Naff's attorney, Bruce Gardner, filed a motion for that preliminary hearing Wednesday morning. Police will lay out their evidence, and a judge will determine if there's enough evidence to put the case before a grand jury. Gardner said the allegation stems from one of Naff's former students. The accuser is a female, and Gardner believes the allegation dates back seven or eight years.
Gardner represented Naff on a harassment charge a different student came forward with several years ago. A jury found the teacher not guilty then.
That wasn't Naff's only legal trouble. About a decade ago, a male student and his parents sued The Country Day School and Naff after the student broke his wrist. The suit claimed Naff was responsible because he was the soccer coach at the time. According to court records, the school paid the family around $7,000.
A few years later, a female student accused Naff of humiliating her during class. Court documents claimed he poked her with a pen and ridiculed her in front of the class about an assignment. The student underwent counseling and therapy. According to court records, the school paid $20,000 to the student.
Naff is currently out on a $50,000 bond.
