A former Gadsden City High School teacher and the teenager he is accused of raping both testified in court about their relationship. A jury is currently deliberating on the case. Nicholas Smith has been charged with second degree rape and also faces a child porn charge for having photos of the girl he is accused of raping. Prosecutors say the Smith was a teacher and coach at Gadsden City and the female student was 15 years old when their relationship began in the spring of 2009. According to court testimony, the girl was not in Smith's class but the two met during a school activity. Both Smith and the student testified that they had a relationship but Smith insisted in his testimony that they did not have sex until after her 16th birthday.
Smith admitted on the stand that he gave the teen an expensive piece of Tiffany jewelry, bought her a dog and shopped with her for engagement rings. He said in court he is still in love with the teenager. At the time of his arrest in 2009, Smith was 26. The jury has been deliberating the case for more than three hours. The trial began Wednesday, Feb. 8.
