Attorneys for the Montgomery man accused of a June 9 shooting at an Auburn apartment complex that left three dead and three injured want to visit the scene of the shooting with their client as they prepare a defense.
The request to visit University Heights apartments was among a series of recent motions filed by Desmonte D. Leonard’s attorneys Susan James and Jeff Leonard remains in the Montgomery County jail, where he has been held at the request of his attorneys since he surrendered to U.S. Marshals on June 12 after a three-day manhunt. Duffey said the request was necessary since Leonard is ineligible for bail because of the capital charges.
James filed a request for the preliminary hearing Friday afternoon, but the Lee County District Court judge overseeing the case has yet to set a court date. The hearing will offer the defense a chance to see details of the state’s case against Leonard ahead of the court’s decision whether to send the case to a Lee County grand jury.
James previously suggested the case should be transferred out of Lee County since some of the victims were current and former Auburn University football players but has yet to file a motion for change of venue.
Auburn police allege Leonard is responsible for the shooting deaths of Opelika resident DeMario Pitts and former AU football players Ladarious Phillips and Ed Christian. John Q. Robertson and Xavier Moss, both of Roanoke, and AU lineman Eric Mack were injured during the shooting.
The current assault charges are based upon the injury of Mack and Moss, but Auburn police say further charges could be pending based on Robertson’s injuries.
Christian was pronounced dead at the scene, and Pitts and Phillips were pronounced dead at East Alabama Medical Center. Mack and Moss were treated and released from EAMC.
Robertson, who was taken to UAB Hospital in Birmingham for a gunshot wound to the head, was released on Thursday, according to hospital officials. At the requests of Robertson’s family, the hospital withheld details about the 20-year-old’s condition during his stay.
